Forced to reduce working hours

I have searched and I didnt find an answer.. could the boss reduce your working hours from 100% to 60% if you are not agree and there is no reason to do it? In case he is able to, does it RAv pays the other 40% you lose during some time? could you refuse? If you are not agree, can they fired to you for this reason and would you get the unemployment money from RAV? Thanks so much in advance.

Without more detail it is difficult for EF's team of armchair lawyers to form an opinion.

Let me see [leaning forward on my armchair] ..... no reason to do it? Would be unusual if they didn't give you one. If they want to change this permanently they have to give you a new contract .... meaning cancelling the old one = cancelation period if you refuse. Depending on the reasons and more info as nickwhodoesn'tliveinBasel said, you would have to contact RAV to get answers about payment of the difference.

They can always fire you in Switzerland .... but they have to stick to the cancelation period.

I work in reception, but the owner of the hotel wants someone close to them works in the hotel, therefore they want to reduce my working hours with " no reason ", just cause they decide it. If I refuse that change, and they decide to fire me, I know I have the notice period ( 1 month beginning the next month after firing in this case) , but I refuse cause that amount wouldnt be acceptable to live in Switzerland... could be this the point to cancel my unemployment benefits... I mean, I just refuse to reduce my contract, they fire me, then I go to rav while I search for a 100% job ( or 20% 60% whatever, but they still pay the 80% of Brutto from last job, wich is much more than 60% netto)...or can I go to Rav and ask for the 40% I lost in the new contract? I hope I explained it better.

In short, yes then can.

They can also reduce it to 0%.

And if you don't have kids, it's 70%, not 80%.

Thats my point of view, much better they reduce to 0% , cause then I am pretty sure I have the unemployment benefits during the search, instead reducing to 60% , refusing, and then no job and no benefits at all. I would like to know if I refuse, I have still the rav benefits or cause I refuse to reduce hours , I dont get any. Thanks.

If they reduce to 60% then RAV will pay 70% of 40%. If you refuse to work 60% then RAV might pay nothing as you legally must reduce any loss to the insurance.

If you earn 70.1% you will get nothing from RAV (80.1% with children) Overtime can cost you a lot of money.

How long were unemployed before this job? You will not be paid for an infinite time, just fyi. Working for a measly 3 weeks or so in between periods of unemployment will not count for much. You also won't be paid 70% of 100%

Also, usually better to have a job than none at all, just fyi.

Thanks a lot ..Fatmanfilms... thats the question I really wanted to know.. cause for me it doesnt make sense.. workin 60% and getting 60% percent of netto, than getting unemployed and getting 70% of Brutto... wich is much more money .. then I know I dont need to refuse, just ask to rav to know how long they pay this amount so I know how much time I have to search a new 100% job.. Thanks for your answer, I am not agree with the sentence better having any job than nothing. At least not in Switzerland, in the sense of if you are alone, and your 60% income its 1800 CHF... and you pay 1400 for the house, 230 for the insurance and lets say 80 for NBK, how you manage to eat? ...not talking about drinkin a beer , or going out, talking about daily food!! no Fatmanfilms, they want to change the contract to 60%. This is not "Kurzarbeit". So RAV will not pay the difference.

I see your point and it's a valid one. BUT: If I were you I'd start looking for a new job now and while you do, work the 60%. It's a better situation to look for work while still having a job (psychological thing with employers )

Right, my experience as well, always easier to apply when you have a job (if possible)

Or just look for an additional job that gives you that 40% back.

If you work 60% you get 88% or 92% with children. Your also building up a new rahemnfrist for 60%

Nothing to do with Kurzarneit, the OP becomes 40% unemployed, so is entitled to benefits.

If he chooses to become 100% unemployed he is walking away from 60% employment & will receive penalty days or possibly zero payout.

"Part-time unemployment due to reduction in pensum

Not only in the event of the complete loss of the position, but also in the event of a permanent reduction of the pensum, there is in principle the right to unemployment benefits. However, the reduction of working hours must reach a certain minimum level, at least one full working day per week.
