Me and my girlfriend has registered partnership in France (PACS). I am a Swedish male and she is French. Would she be able to move with me to Switzerland? I might start a job there and we'll probably be living in Basel.
Hi...just reviving this post and hope someone can shed some light with my situation.
I am non EU but am already in Switzerland with a student visa since last year. My other half is French, he works here on an EU B Permit and we got our French PACS done over a year ago.
Question is: Based on the PACS, what are the possibilities of me converting my existing student B Permit to a Spouse Permit since I am already living here? Or its just 'safer' to extend the student permit?
Here is a clarification from my experience: French PACS is not recognized in Switzerland as a counterpart of marriage or registered partnership, either for heterosexual or homosexual couples, and hence it is not sufficient for spouse permit in Switzerland. Your choice is, either make a marriage, or make a registered partnership (e.g. the registered partnership in UK, Germany... is recognized as equivalent as "partnernariat" in Switzerland, but not the French PACS).
I think those are cantonal laws and are not recognized in the federal level. They are like the French PACS and so they might not be helpful in terms of the right of residence, considering the question of OP is for partner to move to Switzerland?
Agreed, but the OP is also asking if there's a PACS equivelent in Switzerland similar to the one they already have in France. This arrangement is, giving similar rights, responsibilites and protections in every-day life, so covering things like joint bank accounts; but not the same taxation or social security benefits that a 'real' marriage does.
It varies from canton to canton, not being accepted in some, stronger in others. However, wherever they live, it can't be used to claim a 'spouse' permit, but does entitle each partner to more protection than just a couple who live together.
In this case it's probably easiest to just apply to extent the student visa, as they both already live here and have permits. Unless the student permit is due to expire and can't be extended?
Also registering for a swiss PACs (depending on which canton they're in) if they really feel the need to clarify their monetary affairs.
I came to exactly the same conclusion when I looked into this (and asked the Swiss law firm that my company appointed to help me) a little more than 2 years ago - PACS has no value outside France.
