Something like that simply means there is no contract.

And frankly, a seller who doesn’t know the price he sells at is a company I’d probably avoid doing business with in the first place.

If it were a normal price and greatly misstated then they might have a basis for their claim, but it was not and I’d expect if challenged they’ll back down because the consequences of take a case to court could result in them having to make back payments for decades.

Next is if they terminated the contract then all of the terms are void, not just the ones that suit them, so they have not basis to rasie and additional invoice and while to they do have a right to recover their property that is where it ends. It’s unlikely that a judge would award any damages to them under the circumstances.

Simply refuse to pay and forget about it. Why mess around here!!!

And wait for the Betreibung/poursuite that will certainly come.

Ignoring the invoice(s) isn’t really an option unless you happen to be a diplomat in Switzerland! Unlike the rest of us, diplomats enjoy immunity and can legally dodge paying for services or products they have ordered, as crazy as that sounds. This immunity even ties the hands of the Betreibungsamt/office des poursuites, so there is not much Swiss authorities can do about unpaid invoices from foreign missions.

For the rest of us non-diplomatic folks though Swiss law is pretty strict about paying what you owe, even if the online retailer made a mistake on the price. So I wouldn’t recommend your advice to just “refuse to pay”

It doesn’t go straight to court - but on reddit there were a few cases of people getting a betreibung for refusing to pay or return an item that was “mispriced”. The last I seem to recall was a graphics card, where the price didn’t even seem like a misprice (something like 20% less than RRP).

If one did send it back, could one claim money from Galaxus for time spent repackaging and posting back?

To say something good about Galaxus: I got an email today, telling me something in my check-list has dropped in price. In fact it’s almost half price to when I added it to my wish-list.
They don’t need to do that (and it’s not why I added it there), so let’s give them a tumbs-up for that.

My process with galaxus/digitec is to put stuff in the shopping cart continuously (non urgent items obviously) and order whenever we have enough stuff and there’s a discount on one of the items.

Would be a pity if it accidentally fell on the floor or in the toilet before you sent it back

Yes, that is exactly how I do it too. When I need something and am under the free delivery amount I can check if there is something in there I forgot I want/need and haven’t bought somewhere else yet.

Actually I do that on all websites where I shop regularly now. There is so much stuff one doesn’t need urgently and in fact sometimes can be deleted later as I realize I don’t need it at all.
The “this is cool I want it” and two months later “what for?” effect works perfect for me.

I do it with the kids on a regular basis. We put it in the shopping cart, then in a few days they have completely forgotten, I remove it, but they’ve had their dopamine kick.

Compare it to Amazon, where if you buy something, and it drop in price AFTER you buy it, they will refund you the price difference… (not sure for how long, but I’ve had a few things I bought, then got a few francs or rappen a week later refunded)

More likely due to drop in value of euro vis-a-vis the franc. Swiss importers would just pocket the difference and moan about the cost of Swiss labour.

I like win-win situations (gosh am I old fashioned). Only in this case it wasn’t as I had already bought the item somewhere else. But maybe next time.

I once bought a set of earbuds from Galaxus and the next day (my set was still in transit) they put them on 30% discount. I basically said I could return and re-buy at the new price, but would be better to not go through the hassle and they just refunded me the difference instead.

A bit more specific circumstances than a generic refund because the item dropped in price, but still welcome behaviour.
