Goods left behind by previous mieter

hello everyone!

So i moved to a new appartment in october and got a weird contract, in which i continue the contract from the previous renter and we just swap names on everything (i therefore agree with the appartment inspection that he did etc), didn't know that this was a practice feasable to do but seems so

The previous renter has left the appartment in October and left a few goods from him on the Keller, one of those are tyres for his car, he already left Switzerland and the UE, i gave him notice already a few times to come pick them up as i need the space for my stuff, but i dont get any awnser from him, what should or can i do with the tyres?

A fair point is that he told me to keep them until he could sell his car, and at that time the next owner of his car will come pick it up, i was ok with that but it has been 4 months already and I start to need the space

Give him a 30 day deadline then get rid of them?

Basically he's getting free storage space from you when any garage he left them with would be charging him.

Yes that's the idea, the question now is:

- can i get rid of it? i mean i dont know how usually are swiss procedures so I prefer to be sure

- can i sell it? what do i do with the profit? If i cant sell it i'll just take the tires for my car lol

I would inform the landlord via email about it and then list them for sale on Ricardo or Tutti. Inform the previous tenant via email that you are selling them since you haven't heard back from him. Keep copies of all emails. There is no reason you should have to keep his stuff for him.

First, even if you took over the contract from the previous tenant because he left early, you should still have a new contract in your name. It's extremely unusual, and I don't think it's even correct, to just continue an old contract. This could have some legal implications.

Practically speaking you do not have to keep these tyres a day longer. I'd advertise them or ask a garage if they want to buy and collect them. I'd then inform the previous tenant they have been sold, and less your expenses and storage cost you're holding the balance to his order, giving him 3 months to give you a bank account to transfer the money to. Remember to send the money with all expenses for his account and as a reference put "in full and final settlement etc".

This is normal in CH, and actually by continuing a previous contract you are likely to pay less than with a new contract since market prices on average keep increasing. Just make sure there is your name everywhere as others have said - continuing a contract does not mean that you don't do any new paperwork.

And keep in mind that you are responsible for all damages that happened during the previous tenancy. Usually there are no consequences, but should anything come out you won't be able to say "it is the previous tenant's fault". You took over the history together with the contract.

Sell everything than can be sold.

If you have furniture that you want to get rid off and is not sellable --> try to give it away for free / otherwise you need to pay to your local gemeinde some tax for collecting them (and it's calculated per kilo)

I presume you signed something with the landlord or company which is in your name --> that you are now renting ...

Which is why I'd always ask for a new contract. The rent is not necessarily increased and it's anyway necessary to open a new account for the deposit.
