How to handle insurance claim as a victim

My wife was hit by a car while crossing the street over the weekend. She went to the hospital to be checked out and luckily is not seriously injured. There will be lots of medical and other possible claims involved from the incident that will be covered by the driver's insurance. Do I file the claims with my insurance and they will work with the driver's insurance or do I have to work directly with his?

Contact your insurance and let them handle this with the driver ́s insurance. And ask them what you must do.

One detail I forgot to mention is that we have UN's Cigna International insurance, which is outside the national insurance system.

They still will know how to handle this. It ́s probably not the first case they have to deal with.

I want to bump this as we are having trouble with getting our claims processed.

Our health insurance has reimbursed is for the medical claims ( minus our deductable ). But we still have other claims from the accident that we don't know how to file. This includes damage to personal property, taxi rides for doctors appointments, over the counter medical expenses not covered by our insurance, etc... We have asked our contact at the other party's insurance several times for the correct process, but we have not received an answer, except that they do not accept responsibility for a cancelled vacation. She said it is not covered according to Swiss law. .

My wife is employed by a UN agency, so our medical insurance is private and not part of the Swiss system. There is no accident insurance through her employer.

Has the other party's insurance indicated how to claim ? They have zero interest in processing it - and may benefit if you fail to claim within a set period of time. I would just claim for everything and wait for them to reject it.

You could lodge a civil claim for the other damages that are not insured, direct to the person at fault - through the legal system. The first step would be to write a claim letter, sign and send by registered post, with a clear deadline for payment or reply. Direct it to the person.

There is no reason why you must limit your claim to what is insured by the other person.

So then she has it through her health insurance?

No she doesn't have it through her health insurance. The extent the health insurance company is helping is submitting our health insurance bills to the other party for reimursement.
