Kick out a roommate

Hi all, I have rented initially a flat alone and sequently I shared it with another person. He was included in the contract but still the main payment is up to me (obviously he gives to me his part) and all letters from the flat agency are to my name so I guess the contract is on my name.

Since this person is not respecting the house rules and behave inappropriately I would like to kick him out from the flat, what is the procedure to follow?

So is this person's name on the lease or not?

Yes it is

More important: Has this person signed the lease and is a co-renter?

yes he signed, not sure about co-renter

You need to double check - two things are possible:

- you are the sole holder of the lease and you just notified the landlord when your friend moved in that he was sharing the apartment on a long-term basis.

- you are indeed - jointly -or-severally - responsible - which means you cannot just kick him out.

check your actual lease documents (call your agency) to find out first if he is legally included on the lease or listed as a sub-renter.

And then what did he actually sign ?

Yes he signed and I think he is a sub-renter

If both tenants names are on the main lease and both signed the lease agreement, no one can kick the other out. You are co-tenants.

If you rented the apartment in your name only, and advertised for a roommate later, is there a separate agreement? If so, then you might be able to give your roommate notice.
