Konkubinatspaare(lebenspartner) [Registered Partnership]

Hi everyone,

I am a filipina and has a swiss boyfriend. I live here in the Philippines but i visited my boyfriend last year with a 3months visit visa. We wanted to live together without marrying and we heard about this konkubinatspaare. Does anybody here knows about this? Is this really possible? If so, what requirements shall i prepare and what type of visa shall i apply in the swiss embassy? Any reply will be very much appreciated. Thank you! 😊

Your boyfriend needs to contact his commune to apply for a concubine permit for you. He’ll need to meet the conditions - being financially responsible for you for 5 years being one of them. Here’s what Vaud canton’s regulations are:

They vary from canton to canton which is why he needs to check what they are where he lives.

You would need to apply for a Type D visa (long term). If the permit is granted then the visa will be issued and you can get it stamped in your passport.

You and he need to be prepared because they will ask searching and very personal questions regarding your relationship to make sure it isn’t just a sham to get you into the country.

Konkubinat is not a legally acknowledged "status" in most cantons (exceptions apply, Geneva I think is one and one of the other French-speaking cantons as well). You therefore have no special rights just because you're in a relationship and living with a Swiss, i.e. whatever hoops you would need to jump through to get a residence permit you will need to jump through now too.

Thank you for all the infos. I really appreciate them all. For now, we will try this konkubinat to test our relationship. If it gets more stronger then we will get married. He is from Canton Aargau and i hope that they would be considerate to us🙏

This will not be a question of testing your relationship. It needs to already be a long term, commited one - that’s what the authorities are going to be looking for. Something that’s only been going on for a few months long distance with occasional visits isn’t likely to make it.

But as always the commune/canton authorities will have the final say so get your boyfriend to contact them and see what they advise.

For the previous tourist visa your partner had to vouch for you, presumably it'll be the same again, for whatever type of visa you may be eligible for. The fact that your previous visit went smoothly will certainly count for you (assuming that indeed was the case, will count negative otherwise), but nonetheless visa are provided rather restrictively.

Not meaning to be harsh, but this is not about your relationship. You need to realize that as a non-EU, you will generally have a hard time obtaining a residence permit. Initially, you can come here as a tourist for a limited period of time - after that, you need legal residency of some kind or another. You have no legal right to live in Switzerland simply because you're in a relationship with a Swiss. That is what you absolutely need to be aware of. Sure it is possible that your request for residency is granted, but it is not guaranteed as long as you're not married and you shouldn't rely on it! So you better think about alternatives now rather than 3 months in when your tourist visa runs out.

Never experienced this type of application before, but from what I read from several threads on this issue in this forum, your boyfriend also has to agree to financially support you (or statement of such) for 5 years in order to apply the concubine permit, which could get problematic if during the course the relationship doesn't work...
