A career opportunity has come up that would require me to leave for the US for several years and I want to know if my plan is feasible. Some background information:
Family: four (me, wife, 2 children 22 and 18). All dual citizenship (EU/CH).
Apartment rental contract, utilities, everything is in my name.
The children have their studies and prospects here, and they are old enough. So they would stay. Their mum would stay with them too.
My question is: can I keep the apartment rental, bank account, etc., if I deregister and move abroad? Will the mail addressed to me still reach my mailbox? Any other issues I should be aware of?
Thanks!
That might be difficult but it would be fairly easily to transfer to your wifes' name
I agree.
Nothing about this is a big problem as everyone is a citizen (would not have been a problem with C permits either).
Yes you can. There is nothing preventing you as a Swiss from renting an apartment if living abroad.
Difficult to secure one but once you are in its ok.
Bank you need to inform and some will charge.
Utilities etc just keep as is and continue paying.
This should be the easy part: so long as your name is on the mailbox Swiss Post will deliver it there. And which names names appear on the boxes are controlled by your family...
Legally that should be possible as you're all Swiss. It's your choice.
But the question will be, what that means for your taxation and how that affects your family's taxation here. The US will want to tax you as you plan to be resident, but that might mean that your marital household no longer exists for the local tax office, which in turn might mean that your wife gets taxed as a single, which in turn would beg the question which spouse gets taxed on which assets and income.
It may also affect comparably trivial stuff like your health insurance situation. Perhaps other insurances as well.
TLDR: talk to your local tax office.
Sidenote (just saying, I realise that's not your intent):
Both spouses are by law joint renters of the marital home, this overrules the contractual situation.
As a consequence, both spouses [would] need to give notice if you wanted the rental contract to end or either of you to get out. Likewise, the landlord has to inform both spouses, in separate letter, about any changes of the contract or to give notice.
Thanks to all for the very useful replies and points raised. I need to do some more homework, including on taxation and health insurance aspects.
Also to consider: accident and travel insurance.
Plus what happens in case of unemployment? You never know. Assume your company fires you out after 2-3 years, where will you have any claims?
Keep your greffe informed, particularly if you are in a small town or village. Their permission isn’t needed but it could be helpful if they understand what is going on.
