Leaving Switzerland while on RAV

I have informed RAV that I am leaving Switzerland next weekend. Now they say that they need to see a copy of my new work contract before they can deregister me. Has anyone had a similar experience? As I will no longer be working in Switzerland I don't see why I need to provide them with any further documentation.

Yes, I had the same. It's so they know when to stop your RAV payments and you aren't getting any extra days. I guess they need it for their statistics also to make sure you got a job while on RAV

Yes, but why do they need a work contract and not my Abmeldung? Surely they stop payments on the day I leave the country. If I were still in Switzerland I see why they would need the contract but I am leaving Switzerland permanently.

Possibly because you could be entitled to some holiday payments days, so no requirement to be in CH for those if not working. It's also possible to be paid for 3 months after leaving CH if you apply to export your benefits.

I never showed a leaving Cert but did export 3 months benefits, I could have re-registered with RAV in CH after those 3 months as I had not used up my days, however I chose to write that off & not return.

If you stop sending in your monthly form & then tell them you have left they won't send you any money, it would be up to them to eventually close their file on someone who no longer lived in CH & was not claiming benefits.

RAV advisors often make up non existent rules, ask them for the precise law they are referring too

Thanks, I am surprised to hear that RAV pay hoildays. I know that people on RAV may take holidays but it is surprising to hear that these are paid out if unemployed after entitlements run out.

If entitlement has run out, I can't see you have any further obligation to do anything whatsoever.

Sounds like there are no Swiss ducks left if the OP has used up all his benefits, there won't any months to count from Switzerland as the 24 mounth counting period will be passed when 12 in the last 24 next occur.

I am leaving Switzerland on Saturday and have already deregistered and paid my taxes. I am annoyed that RAV are asked me for a copy of my contract with a non-Swiss employer outside of Switzerland. Surely my deregistration certificate should be all they need?

Just inform them on the monthly form if you still do one or by email, their liability has ended & you no longer need to abide by their rules & requirements. I can't see it's even their business that you have left CH.

Only possible thing is accident insurance that they have to provide for an additional month.

I informed Unia on the monthly form. It is my RAV contact who is asking for the work contract. She also asked me to send her all my job applications for this month even after I told her that I was leaving the country to work abroad.

Legally you need to send the job applications if she asks, no requirement for the work contract as far as I can see.

Those "holidays" are meant that way, you don' t have to show any applications to the rav, nothing more.

You can leave the country during those holidays, which was my point. If the job started next week, then there could be 1 day of holidays, I can imagine anyone would start a new job on Friday, no doubt 22Yards will tell me starting a job on Friday is normal.

If the job starts on the 1st of the month, and that 1st happens to fall on a Friday (as it does this week) then, yes, starting a new job on a Friday is normal.

OP, if you have any days of unemployment benefits left over, in other words, if the RAV would have had to continue to pay you, had you not now found another job, then there may well be some sense in your suppling RAV all the paperwork, so their file is complete.

To illustrate: perhaps you're leaving the RAV having drawn unemployment benefits, let's say, for 23 of the maximum 24 months.

If you were to start a new job in Switzerland , but then suppose the new company were to let you go within a few weeks, you would once again be eligible to claim RAV benefits, at least for that last month (the 24th month of 24 max. possible).

Now, as you write, your new job is outside of Switzerland . If that new company were to let you go within a few weeks, you'd need unemployment benefits again. If that new country has a rule, for example, that no-one is eligible for benefits unless they have worked for the full year preceding unemployment, you would not ordinarily be entitled to anything. However, since there are bilateral agreements about unemployment benefits, there may be a way for you to argue for that last month (the 24th month of 24 of Swiss eligibility). For that, you'd need to have all the Swiss RAV paperwork in order.

Thanks. That may be a good reason. I do have 5 months entitlement left. I actually did start work on Friday as it was the first of the month. Good to start on Friday as it was an easy relaxed day.

I told my RAV person that I had now started work in Germany on 1 November and she said that that was fine, no need to send the contract. It seems she just needed the start date, nothing else.
