i have a strange problem and i need some advise
i used to live in kanton Aargau and had a house .last year we were told that our water pipes were not in order ,not just me 4 houses ,the pipes were old and needed replacing i signed a contract on the 6th sept 2022.
i informed the aargau insurance and there was no problem
on the 1st Febuary 2023 we sold the house and fully informed the new owners of this work and left all the information with them
the work was carried out last week after 10 months due to bad weather ??
and now this company keeps sending me the bill ,i have explained all the above to them but they keep threatening me with legal action.
on the 1st Feb after selling the house we moved permanently to Spain all swiss taxes paid
the amount is about 3000sfr can anybody advise thankyou
Did the new owners step into that contract? If not, the company has a contract with you. If you have added a clause to this in your sales contract you could reclaim this from the new owners.
i spoke with the kanton insurance and they agreed they would pay ,but the firm took nearly 10 months to do the work due to bad weather and now i do not have this insurance as i do not have the house also the new owners must have this insurance, and i left all the papers with them its a right mess
You signed the contract with this firm and you both failed to inform them and have the contract reassigned to the new owner, so you are responsible to the firm for this work. Whether you manage to get the insurance company to compensate you or the new owners is not the firm problem, it's yours.
From the company having done the work's perspective, their contract is with you, so that's why they're chasing up with you. If you can't clear it up with the people who bought the property, you may need proper legal advice.
