I will try to present myself here and just write what we're trying to do and what kind of problems we came across.
As the title says we're going to try to move to Switzerland. My wife(swissborn) and 2 kids are Swiss citizen, but I am not. I am Croatian citizen.
I'm currently employed in Croatia and don't want to leave a job without finding one in Switzerland. I'm in IT branch and working for an world famous international company.
For the last 6 months I'm trying to find a job anywhere in Switzerland but I'm thinking that when employers see my address and my phone number I dont even get response as Croatia requires special work permit.
We're thinking to come to Switzerland for 2 months and I'll try to find a job in that 2 months.
Apparently we have to request my work permit through cantonal governance. We have to rent a place to stay.
Another question here: can we airbnb place to stay and use it as a place for getting permit?
Will I be able to apply at employment bureau. Will I be eligible for this?
What were thinking and dealing with is the problem of finding a job from Croatia. We dont want to move without a job and if we dont move i cant get a job.
Please, what im looking for is any advice, and please be free to correct, comment anything I've written as any help is more than welcomed.
Your wife can get a job here FIRST. Then she can apply for you to come over based on family re-union.
I seriously doubt that, but i'm not sure. I'm sure other members will pitch in with a more specific answer.
There. You know EXACTLY your problem.
In case you have some savings (for 3-6 months living expenses here), you can get a work/residence permit based on family reunion, and start job hunting. Prospects are fairly good for highly qualified / experienced IT professionals it seems.
Yep, but she will need to show some means to provide for herself and her husband for an indefinite time in order for the reunification to be approved, which is usually provided by a job or pension. Of course if she is wealthy enough that works too.
Well the law is quite clear on this, Art. 42.1 AuG says
with no strings attached.
The same currently applies to family reunification for C permit holders though that will be over when the new AIG law comes into force on Jan 1 2019 (then they'll be subject to the "no dependence on social welfare" and "suitable housing is available" clause as well, but not Swiss citizens).
I'm guessing that for those Swiss who were asked for proof of income it was just easier and quicker to provide it than to challenge the unlawful requirement in court.
It's also likely that a standard form is used that asks about income, but that's not the same as saying that proof of income is required . Just because a question is asked does not imply a dependence on the answer.
Thank you once more for all your answers as we use your help for a confirmation for our assumptions.
We have moved on 6th November and I've gotten my work permit B on 3rd of January. We have applied for familiennachzug as soon as we have arrived. Work permit is for 1 year and can be regain after 1 year, After 3 years we can apply for C permit.
We have rented a flat. Took a bit risk and signed contract for a year in advance but we had to do it like that.
It should be even quicker, but I still have a job and was working from 20.11. till 21.12. We were asked for an interview on 19.12. but had to postpone till 03.01.2019. I'm still working as I'm looking for a job and waiting for a transfer from my company to Bern office.
There was a lot of procedure going on, and we have come prepared every single time. E.g. we had to had confirmation letters about non criminal record and no tax owned to our country. We had those translated to German language. I just wanted to say that sometimes we felt like we know more about Swiss laws than persons working there and had to call to Bern Canton and Biel office for explanation/confirmations. One time, person working in einwohneramt didn't even know Croatia was in EU. But, OK, we expected a bit more from Swiss public sector, but ok, as long as everything went ok, we're happy even though we had to go there 10 times all together.
Also, the whole conversation was around my wife and as she had citizenship they assured us, all should be ok, and it was.
Once more, would like to thank you all for your help.
