My-store.ch - abysmal customer service

I ordered some cookware from their website at the beginning of last month, and I was given a delivery date of 12-15 December. Its now almost the end of January so I wrote to them asking about my order. They said they are still waiting on their supplier, and as soon as it arrives at their warehouse they would dispatch it to me.

I wrote back to ask for my order to be cancelled so that I could re-order elsewhere. They replied it cannot be cancelled and that I should just wait. According to their T&C I am within my rights to cancel but clearly their CS haven’t read it :roll_eyes:

3.8.1 If delivery is not made within 30 (thirty) days of expiry of the delivery period specified in the detailed description, the customer shall have the right to withdraw from the contract. In this case, any payments already made shall be refunded to the customer. Any further liability for damages and other claims against DeinDeal are excluded.

I’d say get in contact with the credit card company ASAP. Talk about the failure to deliver, blocking payment, etc. There’s a deadline to report this and be able to do something. Don’t let the deadline expire.

Unfortunately its not possible as I paid using TWINT, which doesn’t have the same chargeback mechanism as a credit card. However I have re-written to My-store to remind them of my rights under their own t&c.

Remind them of their T&Cs AND tell them your next step will be to ask your credit card company for a charge-back. That will get their attention.

Ohhhh, that’s another situation. I guess the first email is nice. If nothing happens, registered letter mentioning a potential Betreibung (debt collection).

If it helps for the future, it’s also possible to make TWINT draw credit from the credit card.

Yeah I know, but I prefer to reserve the CC for big ticket items like flight tickets, appliances etc.. and my current account/TWINT for all the smaller stuff.

my-store.ch seems to be just an alternative website for Dein Deal. Never bought from them but I’ve seen ads from this company since I arrived to Switzerland. They’re no small incompetent or fraudulent dropshipper, they were owned by Ringier AG (Blick publisher) from 2015 to July 2024. Then sold to investors from Munich.

At least the business is registered in ZĂĽrich. This is why I mention the Breteibungsamt. Contesting a debt collection process is time consuming. So, the shop might decide to return the money instead of wasting time on disputes.

Apparently they’ve only gone down hill in the last year so the timeline matches with the drop in service.
