I have searched in the forum about changing canton as a non eu B permit holder and was extremely confused by the conflicting reports. I want to ask a couple of questions related to my personal situation and hope this is fine :
I understood change of canton is related to whether the B permit is tied or not to the employer ( again conflicting reports here). My permit says Bewilligung B with note Berechtigt zur Erwerbstätigkeit and on the back says Selbst. Erwerbstätigkeit ist bewilligungspflichtig. This isn't my first B permit i have completed my studies in switzerland and held a B permit for studies for 6 years then a L job search permit for 6 months then this 1 year B permit with my new position. From my understanding this permit is not a permit tied to the employer correct ?
If this isn't a tied to employer permit do I still need to ask for permission from both cantons to move ? The confusion is that some posts say it's fine and that I have equivalent rights to EU citizens in terms of geographic mobility in switzerland. Some also say simply deregistering and registering in the new canton is enough...
As I do not want to mess anything up right now especially since I could get the C in a year and some I wanted to ask if someone else had more or less similar background as my self and changed cantons.
I have reached out to the kanton for info. They said i need to submit an application to ask for permission and depending on many parameters (permit type, open vs restricted...) they would come back to me as to the decision.
I will keep anyone intrested updated through this thread and also explain what I understood once a decision is given on my matter
I received confirmation that I am allowed to cantons by the migration authorities (current and new ones). I had also contacted a lawyer before receiving the ok just to be safe and got more clarifications on the matter.
Basically a C permit or an open ended B permit (could be it's also the same for a restricted one but not sure), entitles you to change of canton as long as you satisfy basic conditions : undefinite work contract, no social benefits, no crimes (the basic ones)...
You have to ask "authorization" from your new canton as a formality only as they are not allowed by law to refuse the change of canton as long as the basic conditions cited above are met. The lawyer explained that this provision in law where you need to ask is just to ensure there is always a migration office somewhere following what you are doing but nothing stops you from moving.
I requested the change of canton formally to ZH canton and received the ok the week that followed after I provided them with the documents they requested : salary slips, contract, extract of debt register and certificate that I do not receive social benefits or help. The new canton would then issue a new permit and this one would not have to go through SEM (no more quotas issues as this only happens the first time) ... Lawyer mentioned this change of canton won't impact the type of permit I am to obtain nor my eligibility to a C permit under the law...
