Non-EU, Canton of Aargau, early C Permit application

I am working in Canton of Zuerich (Zuerich city) and I am living in Canton of Aargau. I am working for the same employer since 2014. I had following permits to live in Canton of Aargau (L, L, B, B) and at the end of 2017 I received the renewal of work permit (in the past I had to renew it every year) in Canton of Zuerich for unlimited time (starts in February 2018 and it is unlimited). I now submitted the documents for new permit in Canton of Aargau and I am waiting for the response (I hope I will receive the permit for more than one year now).

Did anybody applied for early C Permit in Canton of Aargau and succeeded in that process?

I found on the forum info that people succeeded after 5 years (L, L, B, B, B) to receive early C permit in Canton of Zuerich:

I am no expert but I am non-EU (American) who has been living in AG since 2015 and will be eligible to apply for c-permit in AG after 5 years. This is just luck on my part because Americans and Canadians have this privilege. I think it depends on where you are from and maybe other technical details that might be present in your situation.

I have a feeling that this feature with L permit is only valid in ZH and BS... I am studying this case myself, as I search for jobs after 4Y of employment on a PhD B permit and there is a likelihood of getting L now.

Some other cantons, like Bern , explicitly state that you should have a B permit for 5 years, not L . I have a feeling that what you quoted also suggests this for Aargau . You need to clarify with them if the term "eine Aufenthaltsbewilligung" (official name for B) includes "Kurzaufenthaltsbewilligung" (thats the official name for L) or not.

Zurich , as was discussed on this forum many times, counts L on an unlimited contract ( page 8 here ).

Basel is probably most liberal in that sence, saying that both L and B count, independently of the reason for stay, and can be even interrupted for no longer than 4 months ( page 27 here ).

Vaud states that current holders of B can apply, but history does not seem to matter (e.g. 2L+3B should work, as well as 3B study + 2L + B, page 11 here ).

Wallis does not specify this at all, they say just " der ordentliche und ununterbrochene Aufenthalt ", whatever that means.

In general, it seems like getting an early C for Non-EU (non-US, non-Canada) is pretty much a gamble, except for ZH and BS, where it is clearly regulated. Hence, I suggest you move to ZH and apply from there (if your L permit was based on an unlimited contract), or try your luck and apply in AG. In the worst case you will have to wait 2 more years till you have 5 years on B.

got the C-permit in Aargau after 5 years on the B (the 5 year B was my first visa coming into CH). No issues, just request it when you do the permit renewal. When I did it about 4 years ago there was no language requirement so that as that. And that was also linked to changing cantons, was in Vaud and moved to AG, requested C and no issues of tenure in Aargau or Gemeinde either.

My experience of canton Aargau is that they stick to the rules. Compared to Zurich they are not as "foreigner friendly".

I don't know you need to ask the Gemeinde - the Gemeinde will make the recomendation I think and the Kanton will approve or not. For us we didn't ask we just got the C.

Our situation was different we came into CH with 5 year B. (no L or student or 1 year renewalble B). Not sure if being American had any influence on that - rather the 5 year period of having a permit was the influencer (and of course documentation that we paid our taxes and had no debt and no social welfare). Not sure, as noted, if visa type places a role.

But call the Gemeide or Kanton and ask!

No, permit issues are strictly cantonal and the Gemeinde has no say in the process. It only becomes important (and crucial) when/if one tries to get Swiss citizenship.

People at the Gemeinde are not expected to be experts in the law on foreigners and can give wrong advice. The right place to call or ask at is the cantonal immigration office.

There's your answer! I didn't have to bother with calling anybody, showed up to Gemeinde, gave'em my crap and that was that...process then drove it self on automatic.
