Hi all. I would like to have more informations about opening a business. The kind of business would be an on-line art gallery. I will be the owner and I would need to hire the artist that creates the painting etc. and maybe here is the critical point: he is from Serbia and no permit at the moment. I have a permit B.
Will the serbian create art in serbia and sell through your gallery? Or are you hoping for them to do it in CH?
Setting up a company as a B permit holder, with the purpose of obtaining another B permit for someone else, sounds like something the Swiss authorities would be wise to.
Buying in art from serbia to sell online in CH would be easier to do.
And most art gallery arrangements I am aware of don't employ the artists, it's an agency relationship. The artists are freelance.
I agree with you Swiss authorities would be wise. Yes the artist would live here in Switzerland. He will get regular salaries and he will be able to mantain himself, could be this a problem?
Indeed, my wife bought 7 from an artist from Ukraine some years ago, we even went to meet him in Paris 4 years ago at an apero at the Ukranian consulate.
I think would not be difficult to justify it, isn'it ?. The idea is to open a gallery too where he can create art here in Switzerland and he would like to live here
I don't know much about the art world, but unless he's already a world-renowned artist I think it would be very difficult to justify. Try to think of it from the Swiss government perspective: Why do you need to hire this specific artist, particularly as your business is not yet even established? You don't have any sales to prove he's needed. How can you prove you can't find any other Swiss or EU artist to hire? You have to post the job far and wide and conduct many interviews and then submit a stack of paperwork as to why this candidate is absolutely the only one. Why does he need to live in Switzerland, when he can live in Serbia and you can simply buy from him?
You would need to persuade the Swiss authorities, not EF.

I worked in a selling gallery in London and we charged anything from 15 - 25 per cent commission on sales, depending on whether it was a print or an original. Of course this was reflected in the selling price determined by the artist. A number of our regular watercolourists signed deals with the commercial arms of galleries like Tate to sell limited edition prints through, as they got paid for signing each one (back in the late 90s it a was about £5 of the sale price). Card sales also made up their income.
A friend of mine in Scotland sells her modern landscapes via a fine art gallery in Chelsea, her prices start at about £1500 - £2000 because of the commission etc.
