Penalties for hitting pedestrian

My wife was hit by a car over the weekend while crossing the street in a crosswalk. Based on what I have been told by the police and others at the scene is that alcohol was involved (to what extent, I don't know) and that he tried to flee. There were a few people who bravely stood in front of the car to prevent him to go further.

Does anyone have an idea what trouble the driver will be in due to the accident? Hopefully justice will be swift and firm.

Thanks.

Hope your wife is ok.

If the police has identified the driver and there are witnesses, then I would say BIG trouble.

Dan, while I can't answer your question, just wanted to send best wishes to your wife, and to your family.

Hi, hope she’s fine.

Firm outcome of the justice procedure can be a given. Swift? Sorry, not happening.

The general penalties for drunk driving (before hitting anything) are the following. If the driver is a young one or repeat offender, penalties rise. If it’s a young driver, best thing that can happen is getting a nudge (license withheld for some time) that is a motivation to make better decisions in the future. If it’s an elder driver, best thing can happen to the world is getting the license withheld forever.

Once the driver hits something, I’d only expect penalties to increase. So, all above is a baseline.

There are all sorts of combinations in SVG but for example:

Art 92. Anyone who kills or injures a person as a vehicle driver in a traffic accident and flees is punished with a prison sentence of up to three years or a fine.

Art 16b or 16c on moderate or severe offenses. At least one month license suspension, up to indefinite suspension depending on severity and previous offenses.

And fines for all of the above.
