Permis B — work abroad, tax in Switzerland

Hi to all,

I have a question regarding Permis B, working abroad and paying taxes in Switzerland.

I am Portuguese (EU), living in Switzerland and I currently have a Permis B "sans activité lucrative" for 5 years.

I am hired by the European Commission in Brussels for a 6 months contract part-time. I work online and will not leave Switzerland at any point for this job. I have not worked in Belgium before.

I plan to pay taxes for this job and the AVS in Switzerland.

My question is how will this affect my Permis? Will this change into a Permis B "avec activité salarie"? Are there any requirements such as minimum pay?

Has anyone experienced a similar situation?

All the best,

Sofia

I'm not 100% sure, but I think since you're EU you can take your contract to the municipality and the permit can be updated? Maybe the job being remote or the fact it's fewer than 6 months can also have an impact?

As 3Wishes said, take your employment contract to your commune admin office to show them you’ll now be working. The permit will be changed to avec activité lucrative.

Definitely go to the commune office. I have a B visa, tied to my husband's employment and took a contract working remotely for the past 18 months. While the canton was perfectly happy with this arrangement (as were the tax authorities) up to this point, I was told this week that my B visa "Did not allow this type of work." Best to check and eliminate all worries.

Last year I had exactly the same situation and solved it by getting a Swiss Payroll company (helvetic payroll), so I worked 8 months in Brussel for DG Comp and they were invoiced by my Swiss Payroll company who also paid my Swiss taxes and AHV

So for a short time it will work but be carefull also about the Belgians as they are getting tougher on these kind of constructions

Thank you to all for your answers.

Henk, what was your situation in Switzerland then, do you have a permit or are you Swiss? If foreign, did they change your permis?

MegsB, so what did you do? Did you not work abroad? Is it for the Swiss state to tell if you are allowed to work abroad or not?

I already started the job in December and sent the papers now to OCP (Geneva) but no answer yet. In fact, what I need is the Permis to be change to "Pemis B avec activité lucrative" as I already have another job in view that only accepts me in those conditions, so I hope it changes as Medea and 3wishes are suggesting!

EU Citizen with B Permit, had already worked 2 years on the B Permit when I lost the job in Bern, I then went to Brussel without informing the Kanton/Gemeinde and worked there 8 months, in the mean time I applied for a job in Zurich and got it and just went back

I am/was? working for a Chinese owned company remotely. I was told that I wasn't "permitted that type of work" and "I would hear about the resolution shortly." I check the mailbox daily

Best to take your questions to the commune office and not worry. Good luck!
