I am currently working 100% in Credit Suisse(CS) since Sept 2018. I passed my 3 months probation period.
Unfortunately, I suspect that I am 4weeks pregnant and I know this is not a good timing, especially I am still new to the job. Four years ago, I had an early miscarriage (within first 3 months of pregnancy).
1) Is it legal to tell my boss after 3-4 months of pregnancy, when the pregnancy is more stable? I read some posts here and some OPs got fired after miscarriage because the employers think that OPs have the intention to be pregnant again and pregnant employees are expensive for employers.
2) I am not sure about Swiss law. About a month ago, my colleague got 2 months termination employment notice (in accordance to her contract) from my boss. Yesterday, my colleague found out that she is 6 weeks pregnant. Can CS fire her while she is pregnant? Is pregnant employees protected from getting fired since Day 1 of pregnancy until 16 weeks of child birth?
1) You can chose when or even if you want to tell whoever you want
2) You cannot be fired if you are pregnant, even if you don't know about it. CS know all about this and whilst they maybe a bit sharp is some places, i very much doubt if they would try anything on here, the shit storm would be too big for something that is legaly right
Under Swiss law you cannot be fired during your pregnancy and for 16 weeks after the birth of your baby.
They don't necessarily have to pay you maternity leave during those 16 weeks (all depends on the canton and your company's policy), but they cannot fire you either.
A termination by the employer during pregnancy is always illegal even if the pregnancy wasn't known yet to any party. But it needs retroactive proof that she was already pregnant at the time of the termination for it to become void so actually it is a matter of a few days in some cases.
I am aware that pregnant women cannot be fired. But,
I am still a bit confused with the timing. Does it mean that if i am pregnant during my termination notice period, my termination will automatically resume after 16 week of childbirth? In this case, I do not go to work until childbirth because i had been served termination notice?
If i am pregnant before the start of my termination notice period, I am still a normal employee and not terminated employee. In this case, i will go to work like normal until my childbirth. Correct?
