Problems after taking a rent flat

Two weeks ago I moved to my new rental apartment. The day of the "übergabe protokoll" [handover protocol] the paint workers were there so I cannot see the apartment in detail but the "Makler" [broker] told me everything will be ok after the painting works, so I signed the "Ubergabe protokoll", now I realized that I had not to sign it. When finally the works at the appartment finalized and we moved into the appartment we realized that there was many problems in the appartment.

We listed all these problems with photos and we send this to the "Makler", but they told us that we already sign the "Ubergabe protokoll" so, we can not do anything.

We are afraid that at the end of the lease, they take our fee because of all of these problems that we did not caused.

And the other question, I signed the "übergabe protokoll" without my husband, and the date of the "übergabe protokoll" is wrong, can I ask for another because of this?

After signing the handover, everyone has 10 working days to report hidden defects that were not obvious on the "Übergabe"

You have done this in writing within 10 days and with photos.

Write again to the agent and tell him the Swiss law states that you can report hidden problems within 10 days, and you have done so, and he has acknowledged receipt of your letter.

If this doesn't work you can go to court or to the Mieterverein in your town.

Never, ever, rely on others! Next time tell him to come back the next day for your signature.
