Process and timelines to apply B-Permit for Dependent Non-EU Spouse

My wife has recently been offered permanent contract with local Swiss company and her company applied for B permit (Form K) and included my details as dependent in the application.

Is there anything else does she need to provide for me to get the dependent B permit ?

Am I going to get the B permit dependent at the same time or should we submit separate application for dependent B permit ?

What is the time lines to receive authority's decision on B permit and B permit dependent ?

Will I be authorize to work if authority grants family reunification ?

Welcome to the Forum.

Family reunification is not a right for non-EUs, as strange as that sounds. The authorities will be looking for a longer-term contract (i.e. not just a few months) and that she'll have sufficient income to support both of you.

No, you should not submit a separate application if you're already included on hers.

The timeline is hard to say. It takes as long as it takes. If all the paperwork is in order then I've seen 8-12 weeks as a common timeline.

From what I understand, not all non-EU dependent spouse permits allow work at the start. I think if you do find a job you can take the contract to the municipality and they can add the work permission to the permit. But I'm not 100% sure on that.

This. Basically a non-EU dependent B permit is just a residence permit. However if you find a job you simply take your employment contract to the gemeinde/commune to let them know you’re now employed and they’ll do the paperwork to add that to your permit. You’ll get a new one indicating this on it.

However, note that although her company has applied for a B, there’s no guarantee that is what she’ll get if she’s a non-EU national as well. She could be given an L instead and that makes it more difficult for you to work here since any employer has to meet the labour and market conditions for whatever job it is before they could hire you.

Hello everyone

I am non-EU and currently being employed by Swiss organization on L permit dependent with work authorization, which expires in a week time.

My current employer has requested for work permit prolongation/extension with the OCPM authority couple of weeks back and awaiting for decision.

Can i continue to work with same capacity, while its being processed?

I'm a bit worried as my organization has no clue in this regard and expiration date is appearing very fast.

Any help will be highly appreciated!!

Thanks as always!

Cheers!!!

Have you sen this thread?

https://www.englishforum.ch/permits-...t-expires.html

Not sure what that has to do with this situation. That thread is talking about someone extending their permit while they wrap things up to leave the country. OP is asking if they can continue to work while waiting for the permit to be renewed or not.

Yes that's right..suggested thread does not help as it deals with separate situations. I am asking if they can continue to work while waiting for the permit to be renewed or not...Please help!

None of us can tell you with 100% certainty whether you can continue to work while the permit is processing. Even if we say yes, our opinions don't count if you wind up in court.

Ask the municipality that's processing the permit, and do not work until they say it's okay .

The last thing you want is to be flagged as working illegally.
