RAV - Job Refused (not refused)

So this time I had an Job offer from my personalberater, I applied to the job (60%).

I told by email the employer where I applied that I had some restrictions, I have a 15 month years old toddler and I just have place in a Kindergarten 2 day a week, so could could work 3 complete days even weekends but in the week i will need to pick my girl at 18:25, the time that the Kindergarten closes, The employer told me that they work in shifts and as a Buffet/Bar worker in a brewery (in which I have no experience) I couln't go at this time to pick up my Toddler, so she (the employer) told me that she couldn't proceed with my application.

today I recieved a lettler from my RAV advicer that I refused a job!!! and i will be penalised for that! but that's not the truth!!! I never said "No" the Employer showed no interest in my resume and didn't even showed interest in making an appointment in person, to discuss alternatives, or whatever.

What can I do now? this is not fair!

Best make an appointment with your adviser and explain what happened.

If you have a proof of rejection by employer (email, conversation record) or make RAV contact them to clarify that it was job giver who turned down.

1. Do talk with your RAV Case worker about this.

2. In case you do get a written letter that you do get Penalty (looks you did get, how many days? ) react very fast and write your point of view (Einsprache).

Keep in mind your Family situation is dangerous. It is never smart to write much about your Family situation to them (Arbeitslosenkasse, RAV or Employer). Never smart to tell to the might be employer that you can not do this job because your Family must have this or that. No GO !

The authority may assume that you are unemployable or only very limited employable. Both can lead to "Einstellungstagen" or even kick out of the RAV.

Next you can refuse a job when you can not be expected to do it by law.

So the job must "overwhelm" you doing it. So if you have not worked at the bar, so it could be that it is overwhelming you.

Further, do check if the job is far away or not. In case you must drive with public transport longer 2hr per day (one way) no body can force you to accept the job.

Is the job somthing not related to your CV, no body can force you to do it.

Furthermore if the employer told you, he is not interested in you. You should know the reason why is not interested. In case he tells the RAV the story regarding your Family. I do see no chance for you not to get "Einstellungstage".

Check the situation Prior contacting your RAV. The "Einsprache" must be well written in order to speed up the process.

step 2: call RAV and explain exactly the same that you wrote here

step 3: see what RAV says

step 4: if need be, call company and explain

step 5: write e-mail to company, copy RAV, explain situation, ask company to confirm receipt and content of e-mail

And that should resolve it.
