Selling car after import

Hello everyone, hope someone can clear my mind on the following issue:

I relocated to Switzerland January 2021, brought my old car with me.

Finished registering the car and getting swiss plates on it in November 2021.

Now I want to sell the car (in reality I am giving it to a family member that also lives in Switzerland).

I heard somewhere that there is a minimum period you have to keep your imported car before selling it/changing ownership.

Can someone shed some light on this?

Also two more questions:

What is the process? Just go to the STVA and change the name on the car documents?

If I have received the invoice for the insurance for all 2023, and I sell the car in January/February, can I get back part of the premium or is it all lost?

If I remember correctly, min period to wait before selling so you avoid taxation is 6 months - check with the customs office, they've been very helpful with questions I had when I first moved.

To change the registered owner you just go with the grey card to the STVA and the plates and you tell them to do it for you (or you do it by mail with a form you can find on the relevant website).

The restriction on change of owner should be written in the registration papers (look in the "Kantonale Vermerke" section).

To change owner, just go to the STVA and they will cancel the current registration and give the new owner the new one. New owner needs to have insurance arranged. The insurance will pay you back the prorated amount for the months where the car is not registered in your name.

Why would there be any?
You’re free to sell it, albeit possibly with financial consequences.

Mobiliar Insurance clearly imply in their FAQ that there can be restrictions/consequences.

The rules and condition can be found on the Form 18.44 exactly were you have declared your car as part of your household move.

Hint: It is 6 month after you imported it. Day of import is when you got your form 13.20A.

Btw:

Registration has nothing to do with customs. Registration has nothing to do with ownership.

The owner is not mentioned in the gray card. StVA/SAN couldn't care less about the owner of the car-

Change of ownership and change of registered holder are two independent process regulated by totally different laws. Ownership is informal and based on Civil Code and Code of Obligations, holder and change of holder is based on the SVG and VZV.
