Sensitive Photographs, how to protect image rights?

Keystone are taking ages to reply to me so I am thinking that in a couple of weeks, if they can't be bothered to speed up the process, is to put the whole lot of them on the WP in original format & link to Wikipedia site.

I wasn't really thinking of making money out of them, just to reserve my rights & let people see another angle on an important event in Britain's political history.

I've had my pictures lifted from my website and they've shown up in China, Japan and Croatia as well as Europe. Forget the watermarking and other software solutions, the only rule that works is keeping your sample so small that they are absolutely useless to enlarge (so around 100 pix width) and simply not trusting a soul with original sized stuff. I don't have clients as such as I work for my own aviation magazine here in CH, but on the odd occasion that I do send out a few teasers, they end up getting forwarded back to me at some point! It's just too easy to copy and use stuff from the web, once the barn door is open....

I'm learning a lot with info like that, I have other pictures which I want to publish but these to me are of interest to the public & I don't mind them being used actually. I just want to establish that I am the owner of them in a solid way & IF a bigger publisher were to use all/any them then 1. I would know about it & 2. I would expect to get something out of them.

Otherwise, as you have experienced like many, if you publish them yourself (in good quality) you can't expect a mail asking for use of them..

Knowing what you do, how do you feel about the use of photos in the Your Favorite AirPlane ? thread. It's quite obvious to me that nobody is actually running out and snapping a picture of their favourite aircraft, rather the images are being lifted from elsewhere on the web, and are almost certainly copyrighted material.

If you would like to put photos online quite safely, i would suggest using Flash to create a gallery movie with the photos watermarked with copyright note & embedded in it.

If you put it out in the public domain, you're effectively saying "Hey, does everyone like my picture?", you can ask people to respect your copyright, but unless you're buddies with a very bored lawyer, you have no chance of protecting your legal rights. For the airplane thread, everyone lifts the first picture that they googled or went to airliners.net for a cut & paste - it's a favorite site for most middle aged men! My picture is my own - so I have no qualms about posting it, I'm sure that most abused copyright privileges in that particular thread - but who really cares (apart from the original snapper)?

If the photos really are that sensitive: encrypt your laptop's harddrive, copy the photos to the harddrive, take the laptop and get a flight to London to show the pics in person on your laptop. Flights to London can be had for less than 100 Fr. - probably cheaper than FEDEXing the CD.

Update: on the verge of doing a deal with Associated Newspapers (Daily Mail/Mail on Sunday/MailOnline/Evening Standard/Metro for all 26 pics between any (or all) of these.

Unlike the Swiss they love leaving it to the last minute, what a buzz!

btw Keystone (ZH) said they were 'busy', I laughed as I'm sure they couldn't have said that when they were based in London even though they were probably busier.

Going to attempt (including some advice here) to manage them myself...

It doesn't matter what you use, with flash one can still do a screenprint and get your pictures... as was said before keeping the images small so they can't really be printed is one solution, but not a nice one as a small file does not show details well...

A scary thing is the Orphan Works Bill - my friend Mark put it very well:

"The essence of this law is that any image found online which cannot clearly be identified as being owned by a particular author may be reproduced and re-used by anyone. Primarily, this action is being taken to allow media publishers to use photos found online for their own purposes, avoiding the costs of using a picture agency or staff photographer. One argument being put forward is that of the continuing economic difficulties being endured by many, and that their business should somehow be supported at the cost of a photographer.

Even more ridiculously and offensively, the proposal is that the media house who use a picture they have found online pay a fee to the government, in the event that the photographer spots the use of the image and demands recompense. If the photographer doesn’t spot it, then guess what? Yep, that’s right. The government keeps the cash."

My pics have also been lifted by Chinese and other sites, but at least my name is mentioned (the others I could not find with google anyway). I have put up pictures w/o a signature in the past as it was a time saver, but with the Orphan Works Bill I will no longer put any pictures up w/o clear copy right info on it.....

one thing you can also remember - when you make digital copies you CAN write into the EXIF copyright details - it's in the IPTC section and is titled "Copyright Notice".

Or at least in the "user comment" field you can put "(c) your name" - better than nothing.

Stephan - what to do about it though? expensive to get lawyers on both sides to get action to remove the photo eh...

Well I actually don't mind much in these cases as my name is at least mentioned - that's why I found it in the 1st place (google for images with my name)... I don't know how many have been "stolen" without info about the author (frankly I don't want to know). As long as my name goes with it its advertisement and "flattering" and since the files are small only a really bad print could be made...

i was trying to find if there was any way to search the exif info using google but appears not... that way i could look for any photos that has my copyright...

mind you if they open it and resave it in some cheap photo program i'm sure they'd strip the exif out too...

i want to resist watermarking my photos but am starting to think it might be something to start....

mind you - that small watermark with your name at the bottom could easily be removed with a small crop... i know you know that... but i'm trying to work out where the boundaries are - what works, what not and what makes sense and what not

it's a very grey area to say the least!
