Sub-Tenancy in Switzerland

Hello all,

I have been living as a subtenant for last one year. I was paying 'Nebenkosten' of CHF 125 every month. It was stated in the contract that I have to pay for electricity and water cost by myself in the end of the year.

I will be moving out at the end of this month..

Now I received an email from the main tenant that I need to pay electricity bill (which was fair price) + nebenkosten of about CHF2000.

I am shocked since this was never agreed upon.

Also, as a side note- the main tenants have really been acting as a**holes as first they wanted to kick me out in two weeks as it is a mobiliert.

Then when I asked them to use my deposit as a last month's rent-they agreed on the phone and now in the same email mentioned that I haven't paid January's rent- I should pay it immediately and the deposit will be returned after inspection of apartment (okay, fine.. but I am pretty sure they will use my deposit to deduct the above mentioned nebenkosten)

So now I am stuck with a bill of about CHF 4000 in the end (rent+electricity+nebenkosten)..oh and of course the rent for the new apartment.

Was a take over protocol established (state of flat & furniture) before you moved in?

Have you seen the original bills for the nebenkosten? If not demand a copy.

Are you a member of Mieterverband ?

If yes contact them asap & if not join asap.

Do you have a copy of the main rental contract?

Have you checked how much nebekosten is paid there?

For asking you for paying Nebenkosten, they need to show you the invoice they got from the Owners and do it proportional if you are renting a room.

Paying last month rent and not using the deposit for it is normal - but I understand this is annoying from a cash flow perspective.
