Sunrise UPC - Unable to sort out billing

Last year, I swapped from UPC to Salt, cancelled my UPC contract and filled out the online “plombierung” form… and thought all was well.

Recently, I got a UPC bill for the 3-in-1. What’s even more puzzling is that it’s not just 1x bill, but they say it’s 3x 3-in-1 (so 1400 chf for the year)…

I messaged UPC on the web form, and obviously didn’t get a response.

I called, and after three calls - got nowhere. Each call is the same, they cannot find the invoice reference number, they look up my account, then mumble “it’s complicated”… ask me to hold a bit… then hang up on me. (I might even have recorded this)

What do I do now? Not so keen to pay 1400 x year for something I don’t have, don’t need and don’t want… but there seems to be no way to get any escalation?

The funny thing is, that UPC doesn’t accept registered letters as a way to communicate/cancel/etc. So I would need to find the MD’s personal address…

If they will give you that information. Sunrise is a &$##@!!!

You may have to look up the info via official Swiss register.

If you write that registered letter, make sure you deny the charges and ask to prove the charges.

So far as I understand under Swiss law a regstered letter is deemed legally delivered even when the recipient doesn’t accept physical delivery.
I have sent registered letters to UPC in the past and they have reacted.

I see a postal address at Sunrise | Impressum . Why not use that address?

Though it might be a huge pain and waist many hours of your time, I would also suggest to not pay the UPC bill and react if they escalate. Once you had a few backs and forths with them, you could contact A bon entendeur or Kassensturz/Espresso or the ombudsman.

The Zürich court has just ruled that UPC/sunrise must accept registered letters, they have appealed

Die erste Hürde ist geschafft, das Bezirksgericht Zürich hat uns Recht gegeben. Sunrise muss zwei absurde Klauseln in den Allgemeinen Geschäftsbedingungen (AGB) korrigieren:

  • Sunrise muss schriftliche Kündigungen per Brief wieder akzeptieren
  • Abos dürfen bei allen Preiserhöhungen gekündigt werden

Weil Sunrise unsere Klage vor das Obergericht weiterzieht, müssen wir nun ein weiteres Gerichtsverfahren bestehen.

Jetzt gilt’s ernst: Dieser Prozess wird für die Konsument:innen und die ganze Telekom-Branche wegweisend sein. Ein solches Verfahren bedeutet für uns aber einen Kraftakt, den wir nur mit Ihrer Unterstützung weiterführen können.

Interesting. I was not aware that sunrise explicitly excluded cancellation by way of a paper letter in their AGB. Great job, Konsumentenschutz, worth a donation from me!

Minimum contract term

Generally, our subscriptions come with a minimum contract period.

You can cancel your subscription with a notice period of two months at the end of the month, but no earlier than the expiration of the minimum contract duration.

A termination before the end of the minimum contract duration or outside the notice periods is only possible with additional costs.

Ironically, there’s a few things involved.

In 2022 I bought a house. UPC believed it was 3x apartments, so was billing 3x the connection costs. I informed them (on the phone) shortly after (in 2023). They told me to send an email to a specific mailbox (I did). No comms after that.

2024 and 2025 came and went, and I (stupidly) didn’t check the bills and just paid the 1400/year.

In 2025, I cancelled using their web form - again, no comms from them… I was ready to leave it at that… but then I got yet another bill for 2026…
