Swiss Post - Damaged Parcel

Just another timely rant as most are probably receiving their packages after shopping online. I bought some bottles of cologne from a dealer in Ricardo.ch. I was supposed to receive the package on November 25th but never received it. Suspiciously, on the same day, the area around the front door of my flat (I live on ground floor) smelled, REALLY smelled of cologne. In fact, up to now you can still pick up the scent.

Anyway, I checked Post.ch online tracking and saw that indeed it was never delivered; in addition the status shows "Handling of Damaged Item - Mägenwil Distributionsbasis". The following day, I messaged Post.ch on Facebook regarding the issue, and also called up their hotline to open an investigation.

Three and a half weeks later, I am informed over Facebook messaging that "Regrettably, your parcel was been lost after the information, that it was been damaged." I don't really know how to interpret that other than I won't be getting my bottles, and I won't have an idea if all of them were broken. Just seems frustrating that I don't have an idea if someone from Post took the remaining good bottles and declared the package as missing...

Post said they will contact me by email to discuss how I can be compensated. I guess I'm supposed to feel relieved by that... Oh well...

I was not aware that the Post was responsible for your vendor’s inability to pack a fragile item and send it through the post... oh wait a minute, they are not!

Could go either way, couldn't it? Thing is OP will never know, as they didn't even leave it at the address. Without the evidence, no conclusion can be made about how adequately the items were packaged.

You bought something on the basis that the seller deliver it to you. If it does not arrive then it is the sellers problem. Your contract is will the seller, not the shipper he chooses to contract to deliver it to you.

Oh it did arrive. I can still smell it just outside my door after several weeks. Agreed that it's the seller's problem, but then what can he do? He already received payment, and he can also check in Post tracking about the damaged shipment that Post is now saying that is missing somewhere in Mägenwil Warehouse.

Nah. Somebody from Post just wanted to smell gorgeous for their Christmas party. And who wouldn't, it was an Acqua di Parma.

This is the seller's issue, not your. He needs to either get you the products he sold you or refund your moneym then he needs to take it up with the Post and sort out with the post as he has a contract with them about delivering your package - you don't.

Careful with saying to anyone (ricardo, die post or the seller) that the package might have arrived. That will only make harder to put the seller in charge of the problem, because as Jim said, it's his problem.

As long as the postman did not register in their system the package as delivered, it was not delivered. So far, the seller has failed to deliver and it's the least bad outcome for a missing parcel.

It does not arrive until it is handed over to you and if tracked you acknowledge it.

Yeah, true. Just that I'm also a couple of hundred out of pocket so can't help but also feel hooked in this. On hindsight, buying through escrow from Ricardo makes sense.

Thanks, I will try this approach. To be honest, I haven't checked how I can raise it up with the seller/Ricardo. Will do so now.

Nope. Around here, unless the contract or Ricardo's T&C says anything to the contrary, the seller has fulfilled his part by sending the items (ignoring the issue of appropirate packing for fragile items).

IIRC every package is insured by The Post for up to 500 CHF ( requires confirmation ! ). As things stand, if I were OP I'd take the position that The Post fu.cked up (they already confirmed that much by saying it got lost), and that the seller used appropriate packing so they can't reduce the payout. Because it got lost they can't prove the package was broken so this claim is void. Take the money and have the seller send the same again, this time with appropriate packing (and perhaps registered).

If the 500 don't cover the damage I'd contact the seller and try splitting the difference fifty/fifty. Legally the seller has fulfilled his part but in fairness he should have used packing that prevents breaking the fragile flasks. While OP may take the position that the seller shold cover the full excess cost, the hassle would probably not be worth the potential return - it seems better to have a nice xmas than drag the issue into next year for a few chuffs.
