Switch from student visa to full time working permit

Hi all,

I'm a non-EU person holding a B permit with student visa now, I have been in Switzerland for almost 2 years. A few months ago I decided not to continue my study and look for a full time job. I was offered a full-time job recently and they are proceeding the working permit for me now.

My question is: what are the chance that I got reject from migration office? Am I allow to apply for a working permit without finishing my study in Switzerland? I haven't de-registered my program from the University yet. I was planning to do that after I secure my working permit, but not sure if it's possible. Does anyone have similar experience? There’s nothing to stop you applying, but it means you’re subject to the non-EU hiring criteria as Switzerland gives priority to Swiss/EU nationals. This means any employer has to prove they can’t find a Swiss/EU national who could do the job.

Even as a graduate, if you’d been studying outside of Swtizerland, that would be difficult to prove under the criteria.

To answer your question - will your employment application be rejected? - more than likely. You haven’t graduated and have no special skills/experience to offer.

You don’t meet the above requirement.

You’d have a slightly better chance if you graduate here as the non-EU hiring rules are relaxed somewhat for the 6 months after you graduate as far as job hunting is concerned.

Graduate first and then apply for an L permit to allow you to job hunt. This should be granted providing you have the necessary finances to support yourself while you do so.

Thanks for your reply. I should emphasise that my main question is the timing when should I de-registered from the University. I believe you are only allow to hold one of the two VISA in Switzerland: to be as a employee with working permit, or as a student with student visa. I'm just not sure that will the migration office de-register for me from the Uni, or do I have to do this myself? And of course, what time should I do this...

Anyway, I appreciate your explanation of "Qualified employee", and of course, I didn't mention too much about my background in my post because that wasn't a problem to me and to the company at all . I have a MS degree in Computer Science plus over 7 years working experience as a full-time Software engineer in some of the biggest Internet company in US. So I do have some faith that my chance is slightly better than most of the people.

I would still wait until you hear definitely whether the permit has been granted or not. While your chances may be good, there’s never any guarantee of success. If you get approval then it shouldn’t be a problem to leave your course and take up the employment. It would simply be a matter of getting the new, already approved permit from the cantonal migration office. It would immediately replace the student one so you wouldn’t be holding two at the same time.
