One of the streets next to the playground has a sign “privat” (it connects the playground with the main street).
My kid sometimes walks into it/thru it. Can we get a fine for being in that street?
Probably not but some angry neighbours as it is private land.
Provided the child isn’t ‘playing’ on the street or making a lot of noise I cannot see anyone seeking to stop a child from walking to/from a playground. I suspect the sign is there to stop people parking, not walking.
You could possibly get a ban if you drive through it but it depends.
The sign needs to be backed up by a court order. If it isn’t you can ignore it.
If it has a court order, you could be fined for driving along it.
Walking should be fine.
I would drop into your Gemeinde, or send them an email, and ask if you are at all worried about using the street or you could wait until you are confronted.
I’ve walked along many private streets and never had any problems or had anyone tell me I shouldn’t.
Privatstrasse doesn’t mean you can’t use it. Quite the contrary, a Strasse is intended for public use (restrictions often apply for the Privat kind). Usually private roads are kept because the “indebted” party is obligated by a land registry duty to let certain kinds of road users pass through. A Servitut in German.
That often (usually) means the right to pass through for pedestrians, bicycles, and children on toys they ride on, but not for motorised vehicles (cars, bikes, yellow-plated bicycles, etc). Sometimes there’s a restriction, in OP’s case that might require using the playground but that’ll be a given for any child passing through.
What is the actual sign? (foto please)
Private to whom is the question? If it connects the playing ground to the main street and there are no houses on it, then it is most likely to be private to users of the playground… otherwise the owners may get upset, but I doubt anyone is going to fine kids.
I’ve noticed, that when house owners want to forbid pedestrians to walk through their private street or passage, they use a sign with a text or a picture, that explicitly mentions pedestrians.
They still may not have a leg to stand on though as fines normally apply to motor vehicles and walking is fine if it’s not actually private property.
