Withdraw Vested Benefits

Somehow a bit of this got left with UBS when husband moved it over to his last employer. We want to close the VB account and have the money transferred to our current account. I have the form, but for documents needed it says “civil status certificate less than 3 months old/marriage certificate or partnership certificate”.

Would a certificed copy of our marriage certificate suffice for this? And does it need the civil status ones as well?

Is husband retired? Otherwise, it should normally move to the PF of his new employer.

I’d just try with the certified copy of marriage certificate and take it from there if they ask for more (which I doubt they would).

For me even a simple copy of the marriage certificate was enough. But that was 12 years ago. Just ask UBS.

Interesting, I pulled 2 3A last year and I was never asked for a marriage certificate

EDIT: i’d like to correct myself here. UBS is simply following legal requirements, but may be going about it the wrong way. They have to confirm legal requirements that the funds are not shared with your OH or other parties, and belong only to you. Hence they are asking for some confirmation of non-partnership status of you, by asking for ‘marriage’ confirmation. Report of that register will include if you are married/separated/divorced/partnership.

Based on the form, they will inform and ask for confirmation of requested action(s) from other involved parties. In case of divorce, UBS will split the money and entitle you to your share.

UBS should have a form that both you will sign, agreeing to the requested action(s) on the account.

Previous response: If you are still married or have an ‘official’ partner, they should have a form for your OH to sign, confirming that OH agrees to the withdrawl also.

From what I understood of Swiss legal requirements, your OH has a legal right to the funds also. So, UBS only needs confirmation all parties agree to the withdrawl.

Ask UBS to provide you this form …

All these ‘certified copies’ and additional paperwork, are just additional paperwork (imposed by those UBS ‘legal experts’ across the atlantic or outside CH) to legally ‘cover’ UBS. Swiss laws are very clear. UBS or any other Swiss bank only requires confirmation from all account holders that they all agree to requested action(s). What the account holders do with the money is not any business of UBS. Just that UBS properly and legally obliged to account holder(s) request.

I’m not sure about UBS but in general VBA accounts like the one from Finpension provide a lot more freedom to choose your investment strategy which is great.

Yeah, retired almost 3 years ago now. Main bulk was transferred to his new company, but somehow a little got left behind. Can only think that the transfers crossed somehow, but what do I know. Every time the tax return documents arrive I say to myself I must do something about that, but then promptly forget it until the next tax year. But with us planning to leave the country it makes sense to finally get it closed down and the money transferred to our current Swiss account.

Yes, tom the form has places for both of us to sign though the account is only in his name since he was the one working.

A normal certificate is ‘a certified copy of the original’
