Withdrawal of rent agreement cancellation letter

Have you ever given a notice to terminate your rental agreement and withdrew it with in 3 weeks. If yes, how did it go.

in my case,

1/ I gave 4+ months of notice to vacate the apartment I am renting. (sent the letter in registered post)

2/ After 3 weeks, my situation changed so, i have to stay back so requested the agency to cancel the termination notice. They asked me to send this in a registered post, which I did

3/ Good part is agency not yet advertise the property for re-letting and no visitations took place.

4/ Agency is asking me now to sign a new contract as they cannot cancel the notice I sent earlier

4/ Problem is I am staying in this property for the past 10+ years, if I sign a new agreement, then I would loose the lineage and at the time of vacating I have to pay for the Wear and tear

5/ At moment I asked agency why they cannot accept / agree to cancel the termination notice, in spite of the fact, its only 3 weeks since I served the notice,

6/ I checked my rental agreement if any clauses around this exists, nothing I can figure it out, unless it if part of the legal clauses number like OR212 etc

Questions

Is there any place where I can find renter's rights Have you come across this kind of situation, if yes how did you handled Any advice is welcome Are there any rental legal laws applicable to this kind of situation, especially in Zurich

Isn't wear and tear payed based on when things were done / renovated as opposed to when the contract starts?

I'm a bit confused about the issue here... what is your concern? You want to stay on the current contract because then you won't have to pay for any wear & tear damage because your tenancy was for 10+ years, is that right?

We've done it, basically as we had a place that could only be vacated on 30 June with 6 months notice, so every December we wrote a termination letter, which we then renounced some months later, this went on for 7 years or so.

We never needed to do a new contract, however this was a commercial space.

The wear and tear does not reset with a new contract but since the time that specific object was new.

Are they increasing your rent? If not then no worries.

2. No. But the law is simple. S termination is final and can only be rescinded by mutual agreement. While the landlord could do that and just continue with the contract as is, they can also offer you a new contract as they do in your case.

4. new rental agreement --> I was not worried about rent increase. But about the consequences when I vacate the property. For the past 10 years landlord did not do any renovations other than few repairs and once replacing the washer dryer. I heard, after 8 years of stay, tenant don't need to re-painting the house, damages to floor and other wear and tear

Please refer to the Mieterverband links posted above. There's a comprehensive list on the Mieterverband website that details lifespans of particular items when considering "wear and tear". Eight years is by no means the end of your responsibilities as a tenant to maintain the property.

This and it does not reset with a new agreement, rather with the specific item being renovated or replaced.

So if ,our Verwaltung is not increasing prices, they are playing pretty fair and you have no reason to worry.
