So there is little info about this in English online so I'm hoping someone can help:
I'm currently registered in Kanton Zug (C permit) but am living at my girlfriends place part-time in Kanton Zurich (Horgen). Due to some issues, she was away during the initial moving into this new flat of hers and I kind of filled in and signed some of the documents like the Schlüsselübergabe on her behalf so i'm technically signed legally to this flat.
I want to register as a Wochenaufhalter because i'm not there all the time and have to go back to my own residence on weekends ect anyway. Do i need to register or what should I do now that would avoid me getting into trouble / having to register fully in Horgen and pay double rent / give up the years for passport purposes i've put into living in Zug?
It's been a month already so i'm probably late to doing anything but at this point i'm not even sure what to do.
How do you even register as a Wochenaufhalter?
I want to be clear that i'm not trying to avoid tax, just don't want to give up my registration in Zug.
Where do you work? Zug or Zürich? As I think this only works if you are staying during the week in a different place to be closer to work. So if you work in Zug and stay the week in Zürich, it won't fly (that''s how I understand it anyway)
Usually the main and tax residence is considered to be where the heart is, whereas the Wochenaufenthalt is at the romm/apartment you use during the week for work. Which is the inverse of what you have in mind.
Horgen will want your tax money so they may well say you need to move if you ask them, regardless of what is actually necessary. So, maybe enquire in Zug, who will want to keep taxing you and are therefore your natural ally, and in particular which regulations apply.
I've been a Wochenaufenthalter in Zürich for about two decades, without the slightest problem. I believe the worst that could happen is (Zürich's in this case) the demand that you move officially. But with your C permit you have free choice of residence, and you can't be forced to do anybody's whim. And even if something like that were to happen you'd automatically get warned.
If your girlfriend lives there, the moment you register there is no way they won't try to force you to move your place of registration. Have a lawyer handy.
Just get your name off the contract if you did that. The rest is just visiting a girlfriend it's not like you're married.
