Hello, I am a non-EU having worked in Switzerland for about 4 years with B Permit (non-tied) until end of June this year due to laid off.
Originally, due to concern about family reunification, I feel I am obligated to go back to Canada. However, in a recent discussion with my family, they think having a career in Switzerland is also a fantastic thing. That said, my family won't object if I choose to stay in Switzerland.
But problems arise then. I used to think I would leave Switzerland and therefore I did not apply for RAV. Someone told me now it is too late but I wonder if I am still eligible to apply RAV and hence renew my B Permit, which expires at the end of October?
Another question is that given my B Permit is not tied, I wonder if Switzerland employer will still have to prove no suitable Swiss/EU nationals can do my job in order to secure a renewal of B Permit?

You can do nothing but try with RAV, they may accept you for it since you’ve been here so long and have an open B.
And no, if your permit open a Swiss employer doesn’t have to prove they couldn’t find a Swiss/EU national first.
You should have signed up before you last day of work, however there is no problem, just penalty days, more if you cannot show that you've been looking for work since your notice date.

Another potential issue is that I have told the immigration office I am going to leave Switzerland, however I have not yet deregistered. Will this be an issue? I tend to believe not.
What’s your feel for your job market? Is your field very niche or is it more general with lots of recruitment opportunities? Important is that you crack on and start looking now for work. This will boost your chances of avoiding RAV altogether as well as looking more reasonable if and when you apply to them for unemployment benefit.

No obligation to sign up to RAV, you can quite happily look for a job without RAV.
But, seeing you have known since November 2022 that you would be out of work and announce to them in August 2023, they will take very dim view of this.
I think your payments are based on last 12 months of earnings too........
You can apply for jobs at any time.
Start immediately looking for jobs and sign up for RAV now as well in order to minimise your penalty.
If you have not already deregistered there is no issue and as you have an open B it should be easier to find a job as you already have a permit in place.
People only sign onto the RAV because they don’t have another job to go to after losing their current position. It’s not mandatory. You don’t need to get their permission to look for work.
However, I am considering extending my permit by enrolling in RAV, just in case I cannot find a job within three months.

Most likely. But not 100%. If you don't enrol then it'll make things more difficult.
Just sign up, get the money. You just need to keep applying for jobs.

You have known since November 2022 you were going to be laid off, we are now August 2023, 9 months down the road.
You really think RAV is going to bend over backwards to assist you or make special exceptions for you to keep your permit B.
It will be the rule book right down to the last full stop, all "i"'s and "t"'s dotted and crossed, no exception.
Sounds harsh- but you should have been applying for jobs ever since you knew- and would very likely have found a job a long time ago.
The ALV Kasse looks back up to three months for job search efforts expecting 10 to 12 applications and contacts per month.

Some update:
From the RAV office , I emailed the staff explaining my situation and they replied me I can sign up for RAV now.
From the immigration office , I asked if I can extend my B Permit and the staff replied with the following:
".....there is a possibility to make the prolongation of your permit as long as you get the unemployment benefits. In this case we need the confirmation of the Arbeitslosenkasse / RAV (the first payroll)."
My take is 1) Not fully possible to renew and 2) I need a RAV payroll
But given my timeline, is it possible to have my first RAV payroll by the end of October???
