I am in a big mess, I have a learners driving license and in emergency i was driving without any companion. Police caught me!! and took my license I don't know what should i do and how big this offense is?
I also want to put my case that it was in emergency that i have to drive back from unil to home. Person who came with me to Unil can testify that I came with him and since he had urgent work I had to drive myself.
Please suggest what should i do and what can i do and what should i expect
I have no idea what further punishment will happen, but I can't imagine any circumstances in which the police will accept that an "emergency" forced you to drive home alone without a license. Whatever happens, you're pretty much stuck with it.
Neighbor got flashed speeding because his elderly mother was having breathing problems (she was already at the hospital, he was on way). Other neighbor (cantonal police officer) informed him that only (authorized) vehicles driving with a flashing blue light can use the "emergency" exception to the rules of the road.
Did he physically force or threaten you to drive without a valid license or did you choose to do so of your own free will..
The only emergency that could potentially be accepted as mitigating circumstances would be a life or death situation, and only one where the emergency services for whatever reason couldn't help. I'm afraid being stuck in a place without a co-driver does not count as an emergency. You could have taken the train if you needed to get home urgently, and then collected your car, with co-driver, at a later date
As far as to what's going to happen I've no idea, but I don't think you'll get much sympathy.
I don't know as police officer said that his work is only to make a report and authority will make decision on case.
No pretty much it was by my own will to take the car back to parking which was just 2km away.
Police officer said that there will be some fine and I may not be allowed to take practical driving exam. I just wish if i can do something atleast to keep right to test for license.
In this newspaper from 2009 there is a report that the penalty for driving without a license is to be brought is line with driving while disqulaified. Up to 3 years in prison and / or significant fines.
I don't know what it is in CH but in the UK we have a book called, 'The Highway Code' which learner drivers are supposed to read. In the back of this book there is a penalty table listing all the types of offences and punishments. According to the version I have, you seem to fall under 'Driving when disqualified'= 6 mths. imprisonment (12 if in Scotland), a five thousand pound fine, six penalty points added on your licence and it says disqualification is discretionary.
If you're learning to drive, surely you're in possession of such a similar book?
YEP you are in a mess - it will cost you, but mainly you can kiss your licence good bye for quite a while. But if you had had an accident, even if the other driver was at fault- you would be in prison NOW. Remember too that an accompanying driver must be over the age of 23 and have had a licence for at least 3 years. Be grateful for small mercies.
Sorry to say this but surely you understand that you telling them that you considered your situation to be an "emergency" will put your ability to make proper judgements on the road look fairly bad? AND it also says in your theory book that you must not ever drive without a person next to you, so either you don't know your theory or you consider yourself above the law. Both will once more discount any claim you may have to being allowed a license.
So in my opinion you should keep your head down, accept whatever punishment you get and look at public transport more closely, as that's what you will be using for an unspecified period...
