Hello, my mother married a Swiss citizen. We live in Turkey. We have applied for family reunification, but I have a question. According to Swiss law, citizens of third world countries can only bring their children under the age of 18 with them. Türkiye is not officially a 3rd world country, but it is seen as such by most countries. What would be the result in this case? Can I get a residence permit to live with my mother and her husband?
i forgot to mention it. my age is 20.
Hi and welcome.
I know close to nothing about family reunion permits for children.
I can only clarify the 3rd country definition. It has nothing to do with the concept of “3rd world country”. In the context of Swiss immigration law, there are Swiss citizens, EU/EFTA citizens and 3rd country nationals. So, any citizen from any country which is not Switzerland and/or EU, it’s a 3rd country national.
Hope another forum member knows more about family reunion permits for children.
Thats exactly right. You are either Swiss, EU/EFTA or other. Other includes the US, Canada, Brazil, Zimbabwe, Türkiye, etc.
You will have to apply for your own permit, meaning you need a job and a work permit.
So, because the limit of age i dont have a chance in this case right?
Our family reunification application is currently ongoing. What do you think will be the result of this application? I said in my application that if I came there, I wanted to take a language course and work.
No, but you can apply for a job and then get a permit on your own merit.
Your request will be denied as you are over 18.
As OakbrookIL replied.
You can not enter on family reunion visa.
There are certain specific circumstances whereby a family reunification permit may be issued up to the age of 21 for children of third country nationals but it’s quite rare and requires some specific criteria to be met.
I understand and i hope so. If the family renuion only accept for my mother, then i will be alone in my country. So, i will be greatful if they accept it.
Are you working or studying right now or else?
i have highschool degree. currently not working
You don’t additionally have a nationality of an EU/EFTA country do you? And neither one of your parents?
My mother’s, husband has Swiss citizenship. I already said that. but i just have my Turkish passport. I don’t have visa or something.
Sorry to say, but you have no chance of getting a residence permit through your step-father, or through employment yourself.
The only option you have really, is to come as a student, and that is an expensive and temporary solution.
If my family reunification visa is rejected, we are already considering doing as you said. Can I find a job and work there after taking a language course?
And are there any institutions you recommend for me to come to as a student?
A language course is not sufficient to get a permit. Find a job first to get a permit at all and that is not that easy for non EU.
If I come with a family visit visa and find a job, is it possible?
It is a lengthy process hiring a non EU person as the employer needs to show they cannot find anyone from CH or the EU.
Do you have qualifications that make it easier finding a job here?
