I guess I was wrong about not-biased indeed
And if I decide to register at RAV, which option would make more sense:
1. Signing up (fale but whatever) that I quit?
2. Not showing up at the office for 2 months, since my termination is already ongoing?
What happened here is they went the literal way.
Then clearly someone said to them that in order to be in a super save position and cover their asses, to give you notice so that it's incontestable.
You may not like the answer you are getting but it's the answer!
They want to cut you lose as soon and as easily as possible and giving notice is the way
You can go sick and then still be paid for a period of time depending on your seniority. You cannot go abroad so easily though in this case. And if the company is onto to you they will demand extra doc visits etc.
It's hard to have sympathy based on the way you tell the story....
When the company made a mistake and changed the agreement to "cover their assets" (in other words: not to break the law as they initially did) - it's still super ok for you (well, at least finally you admitted), while employee - in your eyes - is only entitled to obey - his/her personal life does not matter at all.
And with all that eventually my simple questiong didn't get answered, but I'll try my luck one more time:
From the employmee's rights and boligations perspective and potential RAV signup perspective, what makes more sense:
1. Signing the document (false but whatever) that I quit?
2. Not showing up at the office for 2 months, since my termination is already ongoing, and getting dock-pay? (I assume that would still mean I get to keep accident insurance and the percentage of 13.th salary)?
3. Coming to the office is not an option after all that bullying and after THAT BEING THE REASON FOR THE REDUNDANCY (Logical)
If you feel differently, just go for whatever answer you want to hear.
You took it upon yourself not to turn up for work after being refused leave and you were terminated. The company then did what most companies would do - give you an out without saying they sacked you as it might reflect badly on you when seeking another job. You were not satisfied with that, so the company then changed their approach at your request and you are not satisfied with that, so you are thinking of just not showing up.... you are the one doing the bullying and trying to get your own way.
You say the money is of no consequence, but are still worried about the RAV...
You are about to breach your employment contract for the second time so of course it will have consequences from the RAVs point of view because your former employer will report it. I can't tell you what the actual outcome will be because it depends of the view the RAV advisor takes. Possible sanctions could include:
- Loss of benefits for a period (almost certain), but apparently that would not be an issue for you
- Very close supervision of you while on the RAV: additional meetings, checking with employers to make sure you actually sent applications and how you performed on interviews
- A refusal to support a permit renewal if you fail to find new employment before your current permit runs out.
So helpful and insightful, thank you!
Angry little feller aren't you.
@Paidpal: Be aware that if you just fail to show up at work, you compnay will not only stop paying your salary imemdiately but tehy are also entitled to seek damages. For example, they may make you copensate the difference between your salary and the charges by an external consultant ready to jump in on day's notice.
I don't know what you do, but for a sw developer for example, even if you are at junior level (say with 10k/month salary), you may be looking at copensating your company at a rate of over 1'000CHF/day for a consultant who needs to be called because you are to lazy to work.
Actually I really hope they do make you pay through the nose....
The RAV will check out what happened, that you can count on.
And as @EPMike points out you could end up liable for employer out of pocket expenses on top of everything else.
