OK, so the current employer will be notified, but as I will have not turned in my notice and assuming they do not terminate the employment contract, do I still have the right to work (keep my current permit) with my current employer should the application with the new company fail? If you have the right to change employers then the question doesn't arise. If not then the question still doesn't arise .

Well, if I don't have the right to change employer, then the new one will be applying for a new permit and going through the process again. So what would happen to my existing permit with my current employer if the new application didn't go through? Will I still have the right to work at the current employer (of course, assuming they don't terminate the contract)?

I am also on a three years contract from my employer ( A French company locates in Geneva). Good to see that as long as the company really wants me to stay after three years, an alternative way can be arranged so that my Permit can be renewed. Am I correct?

In all these cases I would ask myself why the company only handed out a 3 year contract. Restricted B permits are possibly easier to obtain so that could be a valid reason - in the hope that converting later will be possible. Anothe rvalid reason could be that they only want you for 3 years .

A mutual decision. I feel more comfortable with the time length given also.

Also, maybe they need me to relocate for other reasons. And again, a mutual decision will be made by then..

But glad to know there is an alternative/ possibility to renew it after three years! May probably not use it. But still glad to know the door is open.

Could you please share your experience on the conversion procedure in regards to:

1. The reason given to HR to justify the conversion.

2. How long before the expiration of the B-closed permit must the application be submitted?

3. How long it takes till the new permit B-open is granted?

4. Is the new permit B-open entitled for annual renewal or does it work the same like the EU-B where it last for 5 years?

I heard the 4th renewal for NonEU-B is anyway entitled for conversion to B-open, can anyone verify this?

My B-permit is going to expire on August 31st 2011, I am a PhD student and a research assistant at ETH Zurich. My B-permit was issued about 3 years ago (September 2008), and I had to renew it every year.

My employer at ETH has extended my contract until 1st of September 2012. I will be done with my PhD in about October-November 2011 and will have the option to be employed by my research group until Spetmebr 2012.

I am now planing to extend my B-permit until September 2012. My question is the following: Can I apply now for a B-permit which would not be related to my current employer (ETH Zurich) and will allow me to shift freely to some other job once I am done with my PhD (since I live 3 years in CH)? If yes, how can I apply for this?

For non-EU nationals, the B permit is always tied to the employer. For EU-nationals, it is not.

The permit is typically delivered along with a letter from the Federal Migration Office in German, French and Italian, that lists all the conditions applicable to the permit.

If you still have this letter, read it or get it translated. If it says permission is required to change employers, that means it is tied to company.

Naw, really... You can change employers, just need to have it approved before actually changing. Easy? No. Easier than the first time around? Yes. SiUS, any links here?

The easiest, quickest and most unequivocal way to find out (which I did myself) is to call the Bundesamt für Migration in Bern (031 325 1111) and ask them directly. They will be able to locate your permit status immediately in their database and answer any questions you may have.

Some Non-EU citizens are lucky to get an Open B Permit immediately upon arrival, others receive the less coveted Closed B Permit or, even worse, L Permit. I was stuck on the Non-EU L Permit for 2 years before I got an Open B and I made sure I called Bern to get official confirmation so I could resign and join a new company not long ago.

If you leave your job and move out of the EU you will get all of your pension contribution in a cash lump sum.

If the case your company made to secure your permit mentioned that you would only be here for 18 months, it is quite likely that your permit may indeed be closed and tied to your employer.

However only Bern can clarify this as they determine what your permit can or cannot allow, not your company.
