Hello!
I studied my masters in Switzerland then found an employer that did the application and got me a tied B permit. Based on the canton it is tied until December 2024. I am really unhappy in this job and wish to change without risking losing my permit and rights to stay in Switzerland.
Did anyone had to change jobs during the period of the “tied” permit ? And how difficult was the process ? Does the new employer have to do the same procedure all over again ?
Thank you a lot for the help !!
The new employer has to go through the routine of hiring a non EU person. Assuming it is more than 6 months after your graduation?
Yes it would be more than 6 months. So the fact of already having a B permit does not make the procedure more easy ? How tough and risky would that be in your opinion/experience?
The 6 months period is relevant because recent graduates can request a temporary permit (L type) to look for a job.
Having a tied B permit does not make easier for next employer. It's basically starting from zero.
About risk, it all depends on your specialty. For some workers companies are literally snatching them from other companies. For others it takes more time to find work. So, what do your colleagues say? Recent movements to better position, impossible to find a job, listen to them.
Thanks a lot for your precise answer. I work in the pharmaceutical industry so everything will really depend on the willingness of the future employer to do the procedure all over again.
I have not heard about someone in the same situation as me (having a tied B permit and wanting to switch) so hoping to hear some testimonials on this forum
Pharma? I work on Earth science/engineering, so take with a grain of salt my opinion
I also had during my first year a B permit tied to employer. Then, 3 years later my employer went through some reorganization, a new company was created, new name on the commercial register of a different canton...and cantonal population office said nothing when I applied for the renewal of the permit.
Large companies, such as pharma, are better at dealing with B permits. So, I'd assume a higher chance of success of new employer's application.
But, everything is relatively slow in Switzerland. Don't be surprised if an open position announced today, where they are already asking for applicant's CVs, may be scheduled to start on 6 months or more. So, consider a properly executed job switch may take some time. At least wait until permit renewal, so you have 10 or so months of cushion of a recently renewed B permit.
Thanks a lot ! I will start looking then and hope to find a new sponsor willing to do again a procedure.I read on other forums to never resign before having the approval of the new permit.
Indeed! If you resign before having the granting of a new permit you lose your right to stay in Switzerland since your permit is tied to your job. Lose the job, lose the right to stay here.
Thank you ! Also if I decide to stay with this employer for the “linked” period of 24 months do you what would be the procedure after those 24months ? I suppose it’s not a “simple” permit renewal ?
Nope. Employer would have to prove they still can’t find a Swiss/EU national who could do the job before the permit could be renewed.
A renewed B would remain tied. Once you get your C the restrictions are removed.
Even after the 24 months ? I would be tied again to the same employer ?
To the employer who got you your permit, yes.
How tough is it nowadays for a non EU to find an employer willing to do the paperwork for the permit ? Is it better to aim for small companies or big companies ?
Big companies have lots of applications so the chance of being sported might be lower ?
How do you know it is tied with employer?
Should say in the letter that you got with the permit. And it’s very unlikely it won’t be a tied B for a non-EU national.
Hello,
Coming back to this thread.
If a find a new employer willing to do the procedure is there a possibility the canton contacts my current employer while doing the new permit ? My current employer would not be aware that I am applying to a new job and I don’t want to quit before securing a B permit. Did this happen to anyone ?
Thank youu
It does not work like that - you are handing back your current permit and applying for a new one - you can't apply for another B permit while holding one.
So yes, I'd imagine they Canton would go looking for answers. And your future employer might not be very happy to discover how you deceived him into applying for a new permit for you either.
Thank you for the answer.
But to rectify the new employer won’t be “deceived” as they are fully aware they would need to re-do a procedure since my current permit is linked for 2 years and I wish to change jobs before the end of those 2 years. I won’t be applying myself it’s the new employer. But if the canton might contact my current employer to whom I am linked is indeed a risk this is why I am making sure of everything before changing
Iirc, yes, both employers have to agree to the switch.
